May Qualify — Same Kind or Class
ASD is not explicitly enumerated. Qualification depends on documented comorbid conditions or functional impairment assessed at physician evaluation. Adults only — minors require registered caregiver.
What the Law Says
Autism Spectrum Disorder is not named in Florida Statute 381.986. Qualification for adult ASD patients typically depends on documented comorbid conditions that do appear in the statute or qualify under the "same kind or class" provision. The most common qualifying pathways for ASD patients include:
- Epilepsy / seizure disorders: Explicitly listed in FL Statute 381.986. ASD and epilepsy have a documented comorbidity rate of 20–30%. Patients with both diagnoses have a clear qualifying pathway through the epilepsy enumeration.
- Chronic nonmalignant pain: ASD patients with comorbid pain conditions — including GI pain, headaches, or musculoskeletal pain — may qualify through the chronic pain pathway.
- Anxiety: Anxiety is a near-universal comorbidity in ASD. While anxiety does not independently qualify, it may be assessed as part of the overall clinical picture.
Who Qualifies
Adult ASD patients most likely to qualify include those with documented:
- Comorbid epilepsy or seizure disorder (explicitly listed in statute)
- Chronic pain conditions documented by a physician
- Significant anxiety with functional impairment alongside another qualifying condition
- GI disorders — IBS, chronic constipation, or other GI pain — which are common ASD comorbidities
- Sleep disorders with documented functional impairment
ASD alone, without a documented comorbid qualifying condition, is a weaker qualifying pathway and may not result in certification. Physician evaluation assesses the full clinical picture, including all documented comorbidities.
Documentation for ASD Patients
- Formal ASD diagnosis records (psychologist, psychiatrist, or developmental pediatrician)
- Current treating provider records
- Neuropsychological testing records if available
- Records of comorbid conditions
- Epilepsy or seizure disorder records if applicable
- GI specialist records for GI comorbidities
- Anxiety or psychiatric records
- Pain management records if chronic pain is documented

Frequently Asked Questions
ASD is not explicitly listed in FL Statute 381.986. Adult ASD patients may qualify through the "same kind or class" provision based on documented comorbid conditions — particularly epilepsy (explicitly listed), chronic pain, or significant GI disorders. Physician evaluation at Miracle Leaf determines eligibility.
Minors (under 18) cannot apply for a Florida MMJ card independently. A parent or legal guardian must be registered as a Florida MMJ caregiver to obtain and administer medical marijuana for a minor patient. The physician evaluates and certifies the minor patient; the caregiver handles purchasing and administration.
Epilepsy or seizure disorders (explicitly listed in the statute), chronic pain conditions, and documented GI disorders are the most relevant comorbid conditions for ASD patients. Anxiety alone does not independently qualify but may be assessed as part of the overall clinical picture.
Bring formal ASD diagnosis records and all records documenting comorbid conditions — particularly epilepsy records, GI specialist records, chronic pain documentation, or psychiatric records. The more complete the comorbid condition documentation, the more efficiently Dr. Sadow can assess your qualifying pathway.
Miracle Leaf evaluates patients 18 and older for self-certification. For minor patients with ASD, the physician evaluation and certification process involves both the patient and a parent or guardian who registers as a caregiver. Call (561) 888-6111 to discuss the caregiver pathway for minors.
